1. Delcampe Privacy Statement

Delcampe is committed to protecting the personal data of the users of its websites and has therefore implemented organizational and technical security measures to prevent their loss, misappropriation or modification, and this in accordance with the European regulations that came into force from May 25, 2018 (European Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, more commonly known as GDPR).

The use of Delcampe websites and services implies the acceptance by the persons concerned of the processing of their data as described in the articles of point 14 below.

This privacy policy is valid for all pages hosted on the website and for registrations on this website, as well as for all company pages managed by Delcampe on social networks, which is co-responsible with the social network for the processing of the personal data of visitors to the page. It does not apply to pages hosted by third parties to which Delcampe may link and whose privacy policies may differ. Delcampe cannot therefore be held responsible for any data processed on or by these sites.

2. Stored data

Most of the data collected by Delcampe is used to give members access to its services. Thus, the data provided allows members to contact each other about items of interest, to make purchases or sales and to access certain paid services (e.g. postal verification, club+ subscription).

2.1 Data provided by users of Delcampe websites

2.1.1 Data collected when registering on the site

When registering, members are required to provide information. Some of this information is required to access Delcampe services, while others are not. The difference between these data is clearly indicated on the registration form. Delcampe does not collect any sensitive data.

Mandatory data are:

  • Title
  • full name
  • postal address
  • Email
  • Language
  • Date of birth

2.1.2 Data collected when using the website and services offered by Delcampe

Once registered, members have the option of enriching their profile with several other non-mandatory items of information (profile description and photo, telephone number, collecting interests).

Other data must be completed before accessing certain services. For example, to sell on the site, you'll need to provide information on the payment methods you'll be offering your future buyers.

The member may also be asked to provide information when contacting Customer Services via the online form (see point 2.1.7).

2.1.3 Message center and forum data

For these specific points, please refer to article 8.

2.1.4 Data collected for transaction security purposes

Proof (of identity, address and telephone number) may be requested from members in connection with certain services (e.g. postal verification, SMS verification, use of Mangopay) or in the event of suspected fraud or infringement.

2.1.5 Data collected for information and marketing purposes

If the member has given his express consent, Delcampe will use some of his personal data (identification data, hobbies and interests...) to send him important information about the services offered by Delcampe (new features, security...) as well as personalized advertisements.

2.1.6 Data collected via survey forms

Delcampe occasionally organizes surveys among its members in order to improve the quality of its website and services. These surveys are not compulsory and members are asked to give their explicit consent.

2.1.7 Data collected via contact forms

Delcampe provides users of its websites with forms enabling them to contact its Customer Service Department (requests for assistance or information) and its Sales Department (requests for advertising, publication of catalogs, partnerships, etc.). Specific forms are also available for suggestions for improvements or categories.

Depending on the type of form used, the data collected may include surname, first name, pseudonym, e-mail address and any other information that the user deems useful to provide in the content of his/her message and/or any attachments. Users must ensure that they only send the information strictly necessary for their request, and in particular that they do not send any sensitive data.

2.2 Automatically collected data

During use of the website, certain data may be automatically collected by Delcampe servers. This is non-nominative data such as browsing data (IP address, type of browser and operating system used, date and time of access to the site, pages consulted, etc.).

2.2.1 Transaction data

Transaction data is stored on Delcampe servers (purchase and sales history, payment information, etc.).

2.2.2 Data retained to ensure transaction security

In order to identify the person at fault in the event of fraud, the following information may be collected for each action on the site:

  • IP address
  • the Internet domain.

2.2.3 Data retained to facilitate use of the site

During a visit to the site, information may be stored in order to facilitate and enhance browsing.

The only nominative information that can be stored, in the event of a session being opened, is the member's pseudonym. Other information includes parameters such as time zone, currency, display preferences or type of browser used...

2.2.4 Data retained for statistical purposes

In order to make the site more attractive and to facilitate navigation, the following information may be collected:

  • type of browser used (program, version, language, etc.)
  • operating system used
  • hardware type (mobile, tablet or desktop)
  • screen resolution and number of colors

This non-nominative data may be stored in the Delcampe database or in that of the Delcampe partner managing the statistics.

4. Use of the data

Delcampe only processes the personal data of the users of its websites in the following cases:

  • the person concerned has given his/her consent ;
  • the data is necessary for the performance of a contract to which the data subject has consented by accepting these conditions;
  • to meet a legal obligation to which Delcampe is subject;
  • when it is in its legitimate interest to process them, provided that the interests or fundamental rights and freedoms of the persons concerned do not prevail.

4.1 Access to services and support

The main purpose of using personal data is to provide access to services and assistance as defined in article 14.2.

4.2 Data collected to improve service quality and develop new products

Attentive to its customers' needs, Delcampe analyzes information from a variety of sources to offer them services that best match their requirements.

In addition to satisfaction surveys carried out among consenting members, Delcampe uses information stored in its databases (e.g. buying and selling habits) and traffic data provided by its statistics partner to carry out market analyses and audience statistics respectively.

Delcampe then adapts existing functionalities according to the results, or designs new products. Before offering them to users, Delcampe looks for any programming errors by checking new developments in a test environment representing a copy of the Delcampe database.

4.3 Data retained for historical purposes

Certain data, such as descriptions and images of items sold, can be archived, for example to produce catalogs of collectors' items by year.

5. Data collected on behalf of Mangopay

Delcampe may collect on behalf of Mangopay, upon activation of their Delcampe Pay account, the personal data of members necessary for the use and management of the Delcampe Pay account and transactions, as well as for Mangopay's compliance with its obligations under its own general terms and conditions.

The member expressly acknowledges having read, understood and accepted Mangopay's general terms and conditions and the purposes and means of the processing of personal data by Mangopay.

In this respect, the member accepts that the personal data collected in this way may be transmitted to Mangopay's suppliers and partners as part of the performance of its obligations.

However, Delcampe cannot be held responsible for the processing of members' personal data by Mangopay.

Delcampe may disclose members' personal information, in particular names, addresses and account numbers, to Mangopay for the following purposes:

  • prevent, detect, limit and investigate potentially illegal acts as part of the fight against money laundering and the financing of terrorism
  • refund the purchase price, if applicable, in the case of payments made by credit card or payments linked to the following networks: Visa, MasterCard or Carte Bleue

The period of retention of this data by Mangopay is that provided for by the various laws in force.

6. Storage of collected data

6.1 Data collected by Delcampe

Data retention periods depend on the type of information received, the purposes for which it is processed and the context in which it was collected.

Thus, for example, automatically collected browsing data is kept for relatively short periods, generally not exceeding one year. Messages sent via Delcampe's internal messaging system are deleted after one or four months, depending on the type of message, while messages sent to Customer Service by e-mail may be kept for several years.

Member identification and transactional data are kept for as long as accounts are active and for up to 10 years after closure, with the exception of data that may be archived for historical purposes.

6.2 Cookies

Cookies have a variable lifespan depending on their usefulness. Some expire at the end of the session, while others are automatically deleted by the browser according to the time limit set by Delcampe on its servers.

Cookies can also be deleted by the user before their expiry date.

8. Emails

8.1 Emails sent to Delcampe

These letters may be kept and archived for optimal follow-up. In any case, Delcampe cannot be held responsible for the content of the writings of one of its members.

8.2 Emails sent by Delcampe

E-mails may be sent during actions on the website. Not all of them are essential to the smooth running of transactions and the cancellation of the sending of some of them can be carried out via the personal data management interface provided by Delcampe.

Delcampe periodically informs its members via its newsletter. These are only sent to members who have explicitly requested them when registering on the website or via the personal data management interface provided by Delcampe. If the member does not agree to receive them, he/she assumes that he/she is depriving him/herself of an important source of information.

9. Rights of access, modification, rectification and deletion of personal data

9.1 Principle

All users have the right to access, modify, rectify and delete their personal data.

These rights can be exercised by making a request via the contact form: https://www.delcampe.net/en_US/contact.

If a user considers that one of these rights has been infringed, he or she also has the right to lodge a complaint with a supervisory authority.

9.2 Obtaining personal data held by Delcampe

Upon written request from one of its members, Delcampe will send all personal data in its possession.

9.3 Modification and deletion of data by the user

It is possible to modify or delete data via the personal data management interface provided by Delcampe.

In the event of unfounded modification or deletion of registration data, Delcampe reserves the right to refuse access to its services for security reasons.

9.4 Right to be forgotten, right to object and right to restrict processing

The user may request that all or part of his/her data be deleted from Delcampe's databases and those of the service providers with which Delcampe collaborates, or that their use be limited to certain treatments or temporarily.

In some cases, however, Delcampe may not be able to comply with this request, for example if it is required to keep this data in order to comply with a legal obligation.

9.5 Right to withdraw consent

Consent to the processing of personal data can be withdrawn at any time (e.g. unsubscribing from newsletters).

10. Data distribution

10.1 Throughout the site

  • It is forbidden to collect and use, for commercial or other purposes, any personal data that may appear on the site.
  • Members formally accept that the evaluations given by other members about them are visible to all users of the Delcampe website. The publication of these evaluations, reflecting the reliability and seriousness of a member, is imperative in order to guarantee optimal security in transactions.
  • Delcampe will not make public on the website: the name, address or any other personal data of a member without his/her express consent, except for professional sellers who are required to comply with European legislation on the matter.

10.2 For transactions

  • Unless a member expressly objects via the personal data management interface provided by Delcampe, the postal address and telephone number may be communicated by email to members with whom transactions are carried out. In all cases, the following data is communicated on this occasion: surname, first name and email address.
  • Members commit themselves not to transmit to third parties any confidential information transmitted to them within the framework of transactions on the Delcampe website. Likewise, members agree not to attempt to obtain confidential information through Delcampe or its members.

10.3 In public messages (questions, evaluations, forum...)

Members are responsible for the information they provide in public messages. They are aware that they may not disclose personal or confidential information of third parties.

10.4 Off-site

  • Delcampe protects its members' information and does not pass it on to third parties without their prior consent.
  • However, Delcampe is authorized to transmit them to third parties in order to comply with the laws and regulations in force and or any judicial or administrative requisition, to protect itself or its members or any other person. No opposition is possible in this case.

11. Data location and subcontractors

Data from Delcampe websites are stored on Delcampe servers within the European Union.

Delcampe uses subcontractors to provide all or part of the following services:

  • website hosting and maintenance
  • the development of certain software
  • commercial or support services
  • audience measurement
  • postal verification
  • verification by sms
  • mass marketing communications (newsletters)
  • sorting support requests sent to Customer Service (using ticketing software)
  • the provision of an online payment system (via Mangopay)

In order to carry out the tasks entrusted to them by Delcampe, these service providers have access to certain members' personal data. However, they are required not to use this data for any other purpose or to disclose it. Furthermore, Delcampe only collaborates with suppliers who have undertaken to implement technical and organizational security measures in order to comply with the requirements of the European Data Protection Regulation.

With the exception of Zendesk, none of these suppliers processes personal data outside the European Economic Area.

Delcampe uses the services of Zendesk to process member contact forms and satisfaction surveys. Zendesk is a US-based company that complies with European data protection regulations. Personal data is processed in compliance with the EU-U.S. and Swiss-U.S. data protection frameworks.
