    As the buyer it is up to you if you pay the surcharge or not.

    Personally I would politely Email the seller asking him to cancel the sale because you did not see that he surcharged for Paypal mentioning you did check his conditions page where it was not mentioned.

    You run the risk of negative feedback which you can return if you wish stating it was not clear the seller charged to pay him by Paypal.

    Myself I rarely buy from anyone who adds surcharges on to a selling price as it is something I intensely dislike.

    Under the "sales conditions" tab sellers cannot add any information other than the preset tick boxes (maybe it should be changed to be called "accepted payment methods")

    "Message from seller" is an integral part of the listing though and as such it was in the listing.

    As Wycombe says, you can cancel the sale or ask the seller to waive the charge, but you run the risk of negative feedback.

    Having said all that - I am firmly against additional charges and I won't buy from anyone who charges for Paypal, Moneybookers, etc. All the buyer should need to worry about is item price + p&p.
